ARTICLE 2 - SUBJECT

The subject of this agreement is the sale and delivery of the product(s) ordered by the BUYER through the website www.tailpetz.com , which is owned by the SELLER, in accordance with the provisions of the Law No. 4077 on Consumer Protection and the Regulation on Distance Contracts, to determine the rights and obligations of the parties.

The type, quantity, brand/model, color, selling price, and shipping costs of the products are as stated above.

ARTICLE 4 - GENERAL PROVISIONS

4.1- The BUYER declares that they have read and understood the basic characteristics of the product, the sale price, the payment method, and the delivery information on the website www.tailpetz.com , and have electronically confirmed it.

4.2- The product will be delivered to the BUYER or the person/entity at the address specified by the BUYER, within the time period stated in the pre-information section of the website, depending on the distance from the BUYER’s location, without exceeding the legal 30-day period.

4.3- If the product is to be delivered to someone other than the BUYER, the SELLER cannot be held responsible if the recipient at the delivery address refuses the delivery.

4.4- The SELLER is responsible for delivering the product in a sound, complete, and correct condition, with the warranty documents and user manuals, if any.

4.5- The delivery of the product is contingent upon the signed copy of this agreement being delivered to the SELLER and the payment being made by the BUYER using the preferred payment method. If for any reason the payment is not made or canceled in the bank records, the SELLER is relieved from the obligation of delivering the product.

4.6- If, after the delivery of the product, the BUYER’s credit card is used by unauthorized persons in an unfair or illegal manner, and the related bank or financial institution refuses to pay the product price to the SELLER, the BUYER is obligated to return the product within 3 days to the SELLER, provided the product has already been delivered. In such a case, the shipping costs are borne by the BUYER.

4.7- If the SELLER cannot deliver the product within the specified time due to force majeure or extraordinary circumstances such as weather conditions or transportation disruptions, the SELLER is required to inform the BUYER. In such a case, the BUYER has the right to cancel the order, replace the product with a similar one (if available), and/or delay the delivery until the hindering situation is resolved. If the BUYER cancels the order, the amount paid will be refunded within 10 days.

4.8- For products sold with a warranty certificate or not, defective or faulty products may be sent to the SELLER for necessary repairs under warranty conditions. In this case, the shipping costs will be covered by the SELLER.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 7 days from the delivery of the product to the BUYER or the person/entity at the delivery address. To exercise this right, the BUYER must notify the SELLER by fax, email, or phone within this period, and the product must not have been used as specified in Article 6. In case of withdrawal, the product must be returned with a cargo receipt and the original invoice. The product price will be refunded to the BUYER within 7 days after receiving the necessary documents. If the original invoice is not returned, VAT and other legal obligations will not be refunded. The shipping cost for the return of the product is the responsibility of the BUYER.

ARTICLE 6 - PRODUCTS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

The right of withdrawal cannot be used for products that, by their nature, cannot be returned, single-use products, copyable software and programs, perishable items, or products that have passed their expiration date. The right of withdrawal can only be used for the following products if the product's packaging has not been opened, damaged, and the product has not been used:

Portable Computers (No returns will be accepted after the original operating system is installed.)
Any type of software or programs
DVDs, VCDs, CDs, and cassettes
Computer and stationery consumables (toner, cartridges, ribbons, etc.)
Any type of cosmetic products
Phone top-up orders

ARTICLE 7 - COMPETENT COURT

In the implementation of this agreement, the Consumer Arbitration Committees announced by the Ministry of Industry and Commerce and the Consumer Courts at the BUYER’s or SELLER’s location, up to the announced value, are authorized.

By completing the order, the BUYER accepts all terms and conditions of this agreement.
